Follow the process, don’t break the law: Do not leave yourself open to an unfair dismissal claim, even if this is not successful it is time consuming and costly. Get it right first time.
Open and honest communication: Being open and honest with your employee will hopefully avoid or at least reduce conflict in what is undoubtedly a difficult situation.
Document everything: Ensure you document all meetings and keep copies of each letter. Also ask the employee to sign the notes from the investigation, disciplinary and appeal , this will provide confirmation of these discussions and could be used as evidence in tribunal.
Treat your employee with respect: No matter what the reason is for dismissal, maintain your integrity at all times.
